In recent years, regulations from the Department of Labor (DOL) on addressing environmental, social, and governance (ESG) considerations in retirement plans have been contradictory and confusing for plan sponsors. Recently, DOL finalized a new rule that clarifies how plan sponsors can factor ESG considerations into investment decisions under ERISA. The rule has been challenged in the House and Senate and is the subject of a lawsuit filed by 25 states claiming the rule will reduce economic growth and negatively impact participants' retirement savings.
