New Mental Health Parity and Addiction Act Regulations Issued

On July 25, 2023, the Departments of Health and Human Services, Labor, and Treasury (the Departments) issued a package of guidance related to the Mental Health Parity and Addiction Equity Act (MHPAEA), including new proposed regulations (and a related technical release), report to Congress , and compliance compendium. Notably, these proposed regulations expand an employer’s compliance obligations with respect to non-quantitative treatment limitations (NQTL) (e.g., prior authorization, concurrent review, network compensation, etc.) under the MHPAEA. While employers will likely need to rely on their insurers and service providers to comply with the requirements under the proposed regulations, employers should be familiar with these new requirements in order to ensure compliance by its insurer or service provider. Additionally, the Departments continue to report to Congress that employers’ efforts to prepare compliant NQTL comparative analyses fall well short of the Departments’ expectations.
