Overview

Health care will figure prominently in Congress this fall as lawmakers aim for year-end passage of bipartisan priorities including greater transparency and oversight of pharmacy benefit managers (PBMs) and other organizations, increased competition and new billing standards for providers, extended telehealth flexibilities, and eased Affordable Care Act (ACA) employer shared-responsibility (ESR) reporting duties. Meanwhile, the Biden administration continues to aggressively use its executive and regulatory policy-making authority and is issuing critical guidance on numerous health care issues. These include mental health parity, gag clause attestations and other healthcare transparency requirements, ESR affordability percentages and contribution limits, fixed indemnity plans, FTC’s ongoing focus on PBM activities, efforts by regulators to understand the use and policy issues related to medical credit cards, and FDA’s recent approval of the US’s first-in-kind over-the-counter birth control pill. Several cases that may affect health benefits are winding through the courts. IRS and DOL have started to act on SECURE 2.0 changes to retirement plan rules, while PBGC gave a reprieve to some plan sponsors facing a 4010 filing requirement due to the unusual interest rate environment. The regulatory agenda also features executive compensation topics to help companies prepare for the 2024 proxy season.
