The Department of Labor has released the “Retirement Security Rule,” the newest chapter in defining who is an investment advice fiduciary under ERISA.  When the new Rule takes effect on September 22, 2024, it promises to impact the way service providers interact with plan fiduciaries and participants.  At its core, the Rule aims to protect plan participants’ reasonable expectations in receiving investment advice, and to help plan fiduciaries navigate relationships where trust and confidence are critical.
