This session will review the automatic enrollment mandate under SECURE 2.0 that is generally applicable to new plans, including the recently issued proposed regulations, and how that requirement can become in advertently applicable to grandfathered plans as a result of certain mergers, and will discuss strategies that can be utilized to avoid that result.

Learning Objectives:

  • Understand the plans to which the SECURE 2.0 automatic enrollment mandate applies
  • Understand the conditions under which a merger can cause the mandate to become applicable to grandfathered plans
  • Understand how a plan to which the requirement applies can be merged into a grandfathered plan without jeopardizing the surviving plan’s grandfathered status
