Stacy Woods Posted November 14, 2022 Posted November 14, 2022 I was married for about 25 years after that we divorced In 2015 and the judge granted her 1/2 of my 401k (QDRO). But then we married again and divorced in 2018 in which She failed to tell the judge or her lawyer that we had been married before And they granted her half of my 401K (QDRO). In which I just found out that you could only be granted that 1 time. Is that legal? And what can I do now?

CuseFan Posted November 14, 2022 Posted November 14, 2022 and look at the time periods - as each could cover the specific periods of marriage, 50% of those 25 years thru 2015 and 50% for however long the second marriage lasted. hr for me Posted November 14, 2022 Posted November 14, 2022 agree that each QDRO should be applicable to different contribution/deferral/earnings time periods. The 2nd QDRO should go from the 2nd marriage date to the 2nd divorce date NOT back to the original marriage date. Your attorney should have caught that.
