Many fiduciaries of welfare benefit plans have assumed that plans paid from insurance and general assets of the employee (for Form 5500 reporting purposes) don't have plan assets and so the misuse of plan asset rules don't apply to their plan, or that there is no risk of a fiduciary breach if the plan is only paying claims under the plan's terms. These assumptions have been challenged in the recent proposed class action suit Lewandowski v. Johnson & Johnson.
