mjf06241972 Posted June 9, 2020 Posted June 9, 2020 Plan has 1 year wait and entry on the following 1/1 or 7/1. Someone meets the year and now wants to enter the plan in February. Do they have to wait until July (next entry date?) What is the timeframe after the entry date to enter the plan?

You have stated the rules precisely above; entry is on 1/1/ or 7/1 following. So why are you asking about February (though you didn't tell us which February, neither of which make any sense whether Feb 2020 or Feb 2021)? Who cares what the participants "wants"; the plan rules apply to everyone. If he is eligible, say, today (June 9. 2020) then he enters the plan on 7/1/20. What is the real question here? Lawrence C. MWeddell Posted June 9, 2020 Posted June 9, 2020 The question is confusing. Suppose the employee was hired during 7/2/2018 - 12/31/2018 so that 1/1/2020 is the employee's plan entry date. The employee didn't enroll. Are you asking whether the employee could enroll in February 2020 or whether (once the person missed the 1/1/2020 date) the employee must now wait until July 1, 2020? It's a matter of interpreting the plan document, but all the plans I work on would let the person enroll in February 2020 (or any date on or after 1/1/2020 as long as the person remains eligible).
Lou S. Posted June 9, 2020 Posted June 9, 2020 What does the plan say about frequency of changing deferral election? Like Weddell most of our plans allow employee to change their election on any pay period. When was the employee hired? If the fact pattern is like Larry is asking then I agree with him 100% the Participant enters 7/1.
