Dennis G. Posted September 29, 2020 Posted September 29, 2020 As a TPA I'm being asked by a CPA whether paying employees Sick and Family Leave constitutes compensation for purposes of any 401(k) Safe-Harbor contribution. Any thoughts?
Luke Bailey Posted September 30, 2020 Posted September 30, 2020 Dennis G., generally paid leave is W-2 wages and will be countable for purposes of Section 415 and also included in compensation in the plan's definition of compensation. hr for me 1 Luke Bailey Senior Counsel Clark Hill PLC 214-651-4572 (O) | LBailey@clarkhill.com 2600 Dallas Parkway Suite 600 Frisco, TX 75034
