Excerpt: Two district courts recently denied class certification to participants bringing claims related to investments in 401(k) plans, concluding the proposed classes did not meet Fed. R. Civ. P.23(b) (which requires plaintiffs to establish that that the proposed class meets the requirements of at least one of the types of classes set forth in Rule 23(b).
