'Some market participants have expressed concern about the relationship between the [DOL's proposed regulations expanding the definition of a fiduciary investment adviser under ERISA] and the business conduct standards under the Dodd-Frank [legislation] and proposed Commodity Futures Trading Commission (CFTC) rules for swap dealers and major swap participants engaging in transactions with ERISA-covered plans.
