EEOC Releases Final Rules on Wellness Programs

[Guidance Overview] June 16, 2016 "[W]ellness programs that do not include disability-related inquiries or medical examinations are not subject to this final rule, although such programs must be available to all employees and must provide reasonable accommodations to employees with disabilities.... [T]he final regulations are not entirely clear on how the financial limits are to be determined where multiple plans are offered, all of which allow for wellness program participation, or where an employer sponsors multiple benefit packages within a given group health plan."
