Wisconsin FMLA Leave Rights Broadened To Include Domestic Partnerships, Effective June 30, 2009

Excerpt: "On June 29, 2009, Governor Doyle signed the Wisconsin budget into law . . . . The Budget contained provisions which extend the Wisconsin Family and Medical Leave Law ('WFMLA') to domestic partners. There are two categories of domestic partner recognized by the Budget . . .: registered and unregistered. WFMLA leave rights for registered and unregistered domestic partnerships become effective on June 30, 2009. However, WFMLA leave rights for registered domestic partners will not be available to exercise until August 1, 2009, the date domestic partners may begin registering in the State of Wisconsin." California Appeal Court Clarifies Law on Employee Vacation Pay

Excerpt: "A California court of appeal has issued an opinion establishing that an employer in California need not provide paid vacation to its employees; need not provide paid vacation to new employees for a certain period of their initial employment; and may maintain a policy that employees will cease to accrue vacation time in excess of any earned but unused amount in their vacation bank." From Judge Frank Easterbrook: 'Independent' May Replace 'de Novo' to Describe Court's Role

Excerpt: "In a June 29 Seventh Circuit opinion, Judge Frank H. Easterbrook, writing for the court, said that it is time to scrap the Latin phrase 'de novo.' For now, 'de novo review' has only been replaced with 'independent decisionmaking,' when a district court engages in its own factfinding. But the opinion could lead to abandonment of 'de novo review' altogether. Paul M. Krolnik brought suit under ERISA against The Prudential Insurance Company of America, after it terminated his long-term disability payments. At issue was whether Krolnik's ability to work is entirely physical, or mental. The district court barred discovery on medical questions, and granted summary judgment in favor of Prudential based on the administrative record. Krolnik appealed, and the Seventh Circuit reversed. The court began by explaining that 'de novo review' is a misleading phrase for describing a district court's role." (Wisconsin Law Journal)

The Effects of Consumer-Directed Health Plans on Health Care Spending
Excerpt: "We use unique data from an insurer that exclusively offers high-deductible, 'consumer-directed' health plans to identify the effect of plan features, notably the spending account, on health care spending. Our results show that the marginal dollar in the spending account is entirely spent on outpatient and pharmacy services. In contrast, inpatient and out-of-pocket spending were not responsive to the amount in the spending account. Our results represent the first plausibly causal estimates of the components of consumer-driven health plans on health spending. The magnitudes of the effects suggest important moral hazard consequences to higher spending account levels."
