DOL Eases Fiduciary Ability to Deliver Upcoming Fiduciary Disclosures Electronically
"The approach allows electronic delivery of the new fiduciary information if the participant voluntarily provides his or her email address for that purpose. (In addition, an initial notice must be provided, an annual notice must be provided, the transmission of the information must be reasonably calculated to result in actual receipt, reasonable measures must be taken to ensure confidentiality, and the notices must be written in a manner calculated to be understood by the average participant.)"

U.S. Reconsiders Fiduciary Regulation of Private-Employer ESOP Appraisers
"The regulation, as originally proposed, would have expanded the definition of 'fiduciary' under [ERISA] to include appraisers of all private ESOPs. [A Senator] said it would result in new compliance and regulatory costs for private companies that offer ESOPs and could jeopardize the availability of the plans in the future."

Kansas Legislature's Legal Authority to Modify the Kansas Public Employees Retirement System
"There are two primary constraints on the ability of the Kansas legislature to modify benefits under KPERS. The first is a statutory provision limiting the legislature's ability to modify 'existing rights' of members. The second is the obligation not to violate the Contract Clause of the U.S. Constitution."

Industry Group Letter to PBGC Regarding Filing Issues (PDF)
"In our June 24, 2011, letter to you, we emphasized the importance of a supportive relationship between the PBGC and defined benefit plan sponsors—a relationship that can further the PBGC's mission to 'encourage the continuation and maintenance of voluntary private pension plans for the benefit of their participants.' Given that context, we urge you to provide relief so that filers who may have made an inadvertent error, while acting in good faith, are not exposed to what amounts to an enormous penalty in the form of hundreds of thousands—or more—of dollars of additional premiums."

Comparing Compensation: State-Local Versus Private Sector Workers (PDF)
"This study, like many others, finds that state and local government employees earn less than private sector workers with similar jobs and education. The question then turns to benefits. While there is agreement that public employees have more generous benefits, does the public sector benefit package make up for the lower salaries?"
