The Constitutionality of the Defense of Marriage Act is Questioned in an ERISA Case
"This is not the only case where the constitutionality of DOMA is under consideration. Given the developing patchwork quilt of state and local domestic partner laws, this uncertainty about the constitutionality of DOMA leaves employers struggling not only to comply with the law, but to figure out what the law is in the first place."

"In its annual report for fiscal year 2011, the PBGC reported a record $26 bil.lion deficit, a $3 bil.lion increase from the $23 bil.lion reported last year. However, according to [James A. "The Kansas Public Employees Retirement System (KPERS) Study Commission, set up by legislation passed in May . . . approved a plan to close the state's traditional pension plan to teachers and other state and local government workers hired after July 1, 2013, and instead enroll them in a 401(k)-style plan to which they would contribute 6% of their salary."

Actively-Contacted Participants More Likely to Stay with Providers
"According to the study, retirees and pre-retirees that are in contact with their plan provider are twice as likely to keep their retirement plan assets with that provider when changing employers or reaching retirement. The study found that 'active' contact methods (e.g., phone, in-person contact) that allow for personal two-way communication are more effective than 'passive' methods such as postal mail or e-mail."

Allowing New Retirees to Decide What Social Security Benefit Structure Works Best for Them
"There is much talk about the need to bring Social Security into actuarial balance, to ensure that the trust fund stays positive beyond 2035, and the system remains sound for future generations. Why not right that balance and at the same time give Social Security beneficiaries more choices about how and when their benefits are distributed?"

Another Unexpected Twist in the Shareholder Say on Pay Lawsuits
"The new twist is good news. On Monday, the judge ordered the plaintiffs' attorneys to show cause for why the court should not vacate the ruling in the Cincinnati Bell case due to sanctionable conduct by the plaintiffs' attorneys. The conduct alleged is somewhat technical, involving a fib as to the state of residence and, therefore, subject matter jurisdiction, but we will take it any."
