"States cannot be sued by individuals for money damages for violations of the FMLA's 'self-care' provision, a sharply divided U.S. Supreme Court plurality ruled [in Coleman v. Maryland Court of Appeals, decided March 20, 2012]." (Wolters Kluwer Law & Business / CCH)

New FAQs on SBCs Include One-year Good Faith Compliance Period
"[One] FAQ addresses the Departments' basic approach to health care reform implementation, which is to focus on helping plans and insurers come into compliance with the new requirements, rather than penalizing those plans and insurers. To support this effort, the Departments will not impose penalties on plans and issuers working diligently and in good faith to provide SBCs in compliance with the final regulations." (Practical Law Company)

[Guidance Overview]
Contraceptive Coverage Proposals Would Expand Role of Insurers and TPAs
"Although the Notice is only the first step in a process that will eventually include proposed and amended final regulations, it would have a significant impact on insurers and TPAs, who may wish to comment on the Department's proposals. TPAs, in particular, may, among other things, be concerned about: The details of how funding the contraceptive coverage would work. The requirement to assume ERISA plan administrator status for providing contraceptive coverage. Coordinating between multiple TPAs." (Practical Law Company)

The Health Law & Young Adults
"A new study shows that 30% of young adults ages 19 to 25 who initially had private health insurance in 2008 were uninsured for at least one month over the next two years. Young adults were particularly at risk of losing coverage because they may have aged out of their parents' coverage, moved between school and employment or changed jobs. Yet now, the number of young adults with health insurance continues to rise under the health care law." (HealthCare.gov)

Do Health Insurance Reforms Unravel Without an Individual Mandate? The New Jersey Experience
"The Constitution says that the federal government may do whatever is 'necessary and proper' to carry out its other functions. The Supreme Court historically has interpreted that power broadly. If insurance market reform really is more prone to failure without a mandate, that fact alone could, in the eyes of the justices, make the law constitutional. But is the administration's claim correct? For some clues, the justices could examine what happened in New Jersey, a state that tried to reform its insurance markets without a mandate — and failed pretty miserably." (Kaiser Health News)

"The Affordable Care Act includes several provisions that are expected to significantly improve women's health. The [ACA] improves coverage for important preventive services and maternity care, promotes higher quality care for older women, and bans health insurers from requiring women to pay more for the same insurance coverage as men. Over 1 mil.lion young adult women have already gained health insurance coverage because of the [ACA] and an estimated 13 mil.lion more uninsured women will gain coverage by 2016."
