Press Release

FisherBroyles Welcomes Kyle Flaherty in New York

Issued by Fisher Broyles

May 10, 2021

Labor and employee benefits lawyer joins after 27 years at Bryan Cave Leighton Paisner, LLP

New York, NY – FisherBroyles, LLP is pleased to announce that labor and employee benefits lawyer Kyle Flaherty has joined the firm as a partner in its New York office.

Kyle joins the firm from Bryan Cave Leighton Paisner, LLP where he practiced for 27 years and had been a partner in their New York office since 2002.

Kyle represents a diverse group of clients across the ERISA and labor and employment spectrum, serving as general counsel and special litigation counsel to boards of trustees of numerous Taft-Hartley pension and group health plans, counseling ERISA fiduciaries on all aspects of plan management and administration and representing independent fiduciaries to ERISA-governed plans.

Kyle has extensive experience in representing clients in all aspects of withdrawal liability from both the plan and employer perspective.  He also represents employers in an array of labor and employment matters, including collective bargaining, labor arbitrations and general employment counseling, and advises his clients with respect to strategic planning and the labor, employment and employee benefits’ implications of corporate transactions.

Among many notable achievements, Kyle successfully represented a “critical and declining” status multiemployer pension plan in securing the first joint Benefits Suspension and Partition Orders from the U.S. Treasury Department and the Pension Benefit Guaranty Corporation, respectively, under the Multiemployer Pension Reform Act.

Kyle is the co-author of “A Labor Lawyer’s Guide to Avoiding the Surprise Withdrawal Liability Assessment,” published in Thomson Reuters News & Insights, May 2012, and is often quoted in articles published on multiemployer plan related topics.

Kyle received his bachelor’s degree from Montclair State College and earned his J.D. from The Catholic University School of Law.  He is licensed to practice in New York.

Joel M. Ferdinand, Global General Counsel and Managing Partner of Litigation, said:

“Kyle’s extensive and broad experience in representing Taft-Hartley plans brings significant depth to the firm’s employee benefits’ practice group and his decades of labor relations work adds a new dimension to the firm’s employment group.  We are delighted Kyle has joined the vanguard of Law Firm 2.0.”

Kyle Flaherty said:

“Having worked remotely for nearly 14 months now, I have come to see the advantages and efficiencies of working from my home office.  That structure, combined with an impressive collection of self-motivated, highly intelligent and well experienced attorneys at FisherBroyles will provide me with an outstanding platform to continue to represent my clients with the level of sophistication and service they require and deserve.”
