The Amendments clarify that plans or insurers must provide benefits following a final external review decision without delay. A plan or insurer cannot refuse to provide benefits on the grounds that it intends to challenge the decision in court. However, a court decision contrary to the final external review decision would be a basis for not providing benefits.

Syntax Enhancements for Standard Searches

  • Quotation marks can be used to require an exact phrase, such as
    "standard of review"
  • When CAPITALIZED, the words AND, OR and NOT are logic operators, which are especially powerful when multiple words (e.g., synonyms) are grouped in parentheses, such as
    (vested OR vesting OR lifetime) AND (retiree OR retirement) AND (health OR healthcare) AND (benefits OR coverage)
