Oct. 9, 2001 "A federal appeals court ruled that ERISA group health plans that do not include the 'vicious circle' exception rule in their coordination-of-benefit provisions will be the primary payer of benefits for retirees.... When self-insured ERISA plans do not include the vicious circle exception into their COB provisions, the plan covering the person directly (usually as a retiree) will be primary ...
