Excerpt: On a coordinated basis with the Departments of Treasury and of Health and Human Services, the Department of Labor recently established an 'enforcement safe harbor' by which supplemental health insurance will be treated as excepted from certain HIPAA portability requirements if it meets a straightforward four-part test.
