IRS Regulatory Agenda Reflects Focus on Group Health Plans


The IRS's Semi-Annual Regulatory Agenda reflects that its focus in the next several months will be on finalizing various regulations under the Patient Protection and Affordable Care Act PPACA).

Among the matters targeted for completion by June 2012 are final regulations on:

  • HIPAA Portability: Special Enrollment Procedures, Tolling, and Interaction With FMLA
  • Notice to Participants of Consequences of Failing To Defer Receipt of Qualified Retirement Plan Distributions; Expansions of Applicable Election Period and Period for Notices
  • Genetic Information Nondiscrimination Act
  • Certain Employee Remuneration in Excess of $1,000,000 Under Code Section 162(m)
  • Regulations Under the Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008
  • Group Health Plans and Health Insurance Issuers Providing Dependent Coverage of Children to Age 26 Under the PPACA
  • Group Health Plans and Health Insurance Coverage Rules Relating to Status as a Grandfathered Health Plan Under the PPACA
  • Requirements for Group Health Plans and Health Insurance Issuers Under the PPACA Relating to Preexisting Condition Exclusions, Lifetime and Annual Limits, Rescissions, and Patient Protections
  • Requirements for Group Health Plans and Health Insurance Issuers Relating to Coverage of Preventive Services Under the PPACA
  • Requirements for Group Health Plans and Health Insurance Issuers Relating to Internal Claims and Appeals and External Review Processes Under the PPACA
  • Summary of Benefits and Coverage and the Uniform Glossary (Issued in February 2012)
  • Modification of Treasury Regulations Pursuant to Section 939A of the Dodd-Frank Wall Street Reform and Consumer Protection Act
