Hi Andy, I purchased a laptop to connect to my office via SSL. At the time, my office's version of SSL was not supporting Vista - unfortunately, I didn't know that until too late. So, my only problem with Vista was self-inflicted, however I'd heard many horror stories myself. To solve my problem, I removed Vista completely and installed a brand new full version of XP Pro. My office had purchased a few extra licenses, so I had no financial issues holding me back. I do not think I would have done this if I had to pay the couple of hundred to purchase a new license. After installing, I had to find/load all my drivers for XP rather than Vista, but I was able to pull these all from the internet. I can't remember all the steps, but I just googled instructions and they were very easy to follow. So, though I'm not too helpful in providing you instructions, I know it can be done successfully. ERISA Sec. 404(a)(1)(D) requires plan administrator to follow plan documents when determining beneficiaries. Thus, this info will not override a designated beneficiary form. I'm assuming the beneficiary form listing spouse #2 was dated sometime during their marriage, not after their divorce. The Plan Document should have a section pertaining to beneficiaries and divorce. Our document states that a divorce or legal separation revokes the spouse as a Beneficiary unless a decree or QDRO provides otherwise. Therefore, we'd interpret this to mean that even though there's a bene form out there listing spouse #2, she is NOT, due to divorce. If he were still married to #3, she would be the beneficiary; however, since he was also divorced from #3, same thing applies...NOT the beneficiary. This is something of which I've never heard...seems like we have balances languishing around forever! With whom are you having contact, the Plan Representative, the fund company rep or the Third Party Administrator? I suggest you write a letter, cc'ing all of the aforementioned. As the executor of his estate, you should request copies of the SPD, plan doc (at least the portion relating to determination of benefits upon death) and the beneficiary form they have on file. Attach certified death certificates to each letter. Also, if you can get your hands on the decrees of each divorce, attach copies. Finally, specifically ask in your letter if the Plan Document addresses beneficiaries and divorce...this way they'll have to look it up. Good luck!

Ok, so my guy (who's <50 yoa), who deferred $16K for the plan year 4/30/07 (and $14K for plan year 06) would have been ok had he deferred at least $500 of it during calendar year 06 and no more than $15,500 of it during calendar year 07, right? But, since he deferred the full $16K during the calendar year 07, he's over on his 402g limits by $500? Did I think this all through correctly? I just thought of another question...what if he had deposited the full $16K in December 2006? Assuming no other contributions during 06, is he over 402g limits in the amount of $1000? thanks! Annie

Hi, my brain's not working and I'm going around in circles, so I'm wondering if someone could verify my #'s before I call my attorney client and get myself in trouble: Plan is 5/1/06 - 4/30/07 Comp limit = $220,000 402g limit = 15,500 (or $20,500 for aged 50+) Annual Addition max = $45,000 (or $50,000 for aged 50+) HCE = comp > 95K 5/1/05 - 4/30/06 (doc does not use calendar year comp) thanks! Is the 4/1/07 deadline for RMD's pushed to 4/2/07 because the first is a Sunday? I have been searching everywhere for some written guidance, but can't find anything. If your answer is yes, do you have a cite? thanks! Annie

I'm sorry to steal the thread, but I didn't feel mine was worthy of it's own question...I'm trying to better understand plan design. Would this be a good situation for a SH Match? All HCE's could potentially defer $20K (if catch-up eligible), get a SH Match of 4%, a discretionary match of 4%, and still meet top heavy with the non-keys receiving nothing if they did not defer, right? thanks!

Ok, well, darn it, it was easier to blame quantech than myself!! Heeding your advice, the software is now matching everything I'm doing. We're at version 11 and I was not able to get it to run both in and out automatically (of course, it may be possible and I'm just clueless), but it was easy enough to run with and without myself and pick out what I needed. This plan actually had the same issues last year. (But I'm not going to look at that too closely...) I appreciate your help! Thanks!! -
My cross-tested 401k PS plan is top heavy and fails the adp test. Eligibility is: k - immediate; PS - 1 year dual, 1000 hours and last day required; QNEC - 1 year dual. 4 ees; 2 hces 2 nhces (1 nhce is t<501, so no TH or PS for her) A 5.48% qnec satifies ADP test. qnec satifies TH. qnec can be used in Gateway. qnec cannot be used in 401(a)4. Relius is giving me 2 issues: 1) It's putting my t<501 into 401(a)4 (but correctly excluding her qnec) 2) It's putting my t<501 into Gateway test as a 0, incorrectly excluding her 5.48% qnec Am I right, t<501 shouldn't be in either 401(a)4 or gateway? But, even if she was in gateway, can't her qnec count towards it? the non-discrim test page that shows employees included/excluded under IRC 410(b) shows "term" under remarks, which may or may not be correct - I'm not sure. But the page that shows who benefits has a "yes" under benefiting 401(a). I'm thinking it should show *** for excludable...what do you think of all this? Am I way off base, or is Relius screwing up? thanks!

Yay!! No more "copy, paste specials" for me!! You know what amazes me...all the time we've spent over the years looking for ways to work around something, when, all this time, Relius probably already has a quick way to handle it. Sometimes I feel like my office needs to go to a basic training course. Thanks!

I wondered what other TPA's out there are doing about force payouts above $1,000. We cannot find an institution willing to open an IRA without the IRA owner signature, so unfortunately if the amount is more than $1000, they've not been done. Many of our plans amended for force outs for < $1000, but those that didn't will continue to be a problem. What are you all doing?

Well, I'm not sure what to do to get around this problem, because I haven't had it. Have you installed it just as a printer choice? That's what we have. So, instead of printing to the HP laser, I choose CutePDF and print. I know that isn't technical and I'll keep looking to see if I can get an answer. It has been installed as a printer choice. So, now I can choose that specific printer, rather than my default printer. Here's the error I'm getting, "Postscript printer drivers are not supported for Non-EFAST forms. Please select a non-Postscript driver using Print Setup under the File menu.". I've had this error before, when trying to use my HP Laser Jet 4000 printer. The fix was to add a print driver for HP Laserjet IIIsi, point it to my 4000, name it something unique then use that printer for my default printer. But when I do that to the CutePDF printer, it starts printing to the printer. I know this is complicated and more than what a message board might be expected to do, so I don't expect you to work on trying to get an answer. I posted this more in case someone that's already had this problem might be able to suggest something. But, I do thank you for your help, and the suggestion to use CutePDF!!

Bill, This is a great program, I just installed and tried it with word and excel, thanks!! I cannot get it to work with Relius, though. It's giving me that error about post script printer drivers; that I should choose a non PS printer driver under the file menu...how did you get around this? thanks!

In Relius 5500 software, is it possible to somehow print the 5500 and schedules (like a batch print) to a file? So many auditors want to see a draft 5500, but don't use the same software. So I end up printing, then faxing 20 pages, just to have to end up making changes and print and fax again. TIA!

We started playing with it before checking back here for answers, and ended up fixing it by doing the following: Going to plan specs, allocation provisions, gains/dividends screen and changing the balance determination to effective date (changed from trade date). Thanks for everyone's help, though. This board will be a great resource!! I've been using Relius for about 7 years and still feel as if I learn something new about it every day!

Has anyone ever had this problem? You enter a new plan into Relius (a takeover) and enter beginning account balances. When you try to post the gain for that year, you get an error message that it cannot post because there's a zero basis. The census account screen shows beginning dollars and units, but there's no beginning cost basis. Is this related? This is a PS with 1 employer account and 2 rollover accounts, all cash.
