  1. yeah. mine moves!
  2. ^ unless the plan has fail-safe language. Then you lose the ABT for coverage. (I'm pretty sure)
  3. At my old job, we had daily valued plans on Relius, but we had a dummy plan to use to try stuff out. Just make sure you uncheck "confirm required."
  4. Pad your bill!
  5. BRF: Benefits Rights & Features testing. Gotta make sure it's not only the HCEs who can and are getting the enhanced contributions.
  6. First, does the plan allow for an additional discretionary match?
  7. What about BRF testing?
  8. Someone in my office seems to think April 15 is an important date for ADP refunds of Roth deferrals, ut they can't put their finger on it. Leafing through (though not perusing) the EOB, I just see that Roth ADP refunds just go on a separate 1099-R from regular deferrals as the basis is not taxed. I do not see any reference to April 15 anywhere for ADP refunds of any sort. Googling "ADP Roth Refund April 15" gave me this nugget: http://www.ars401k.com/Roth401k.pdf On slide 8, referring to ADP refunds, it says: Is that right? All the other links lead to discussions on 402(g) excess deferrals, not ADP refunds. As always, your thoughts are appreciated.
  9. Everyone would be out to get you if you weren't selling those evil 419(i) things that are tax shelters or maybe they aren't or maybe they are on every other Monday. Wait a minute! We all sell those things. Not a thing wrong with them, IMO! [/sarcasm]
  10. You could always exclude ONLY HCE bonuses.
  11. Only if you expect to receive at least $1,000 over the life of the contract (not per year, but per contract). And notices must go out if you COULD get revenue from the plan, not IF you do.
  12. Might be helpful to remind MM they aren't the only game in town. There's always The Hartford! (/sarcasm)
  13. So, it looks like it's just the earnings that are due back in the account and that EPCRS says it's not up to the ER to fund it. Now, MM is saying the ER must fund it. What is MM gonna do if they don't pay it? (Can you get a copy of the MM service agreement? Maybe there is something in there.)
  14. It means that you can't cap deferrals at less than 5%.
  15. From EPCRS, failure to implement instructions for partial year. (spacing added) Appendix B, Section 2.02 (1) (a) (ii) (B) (2)
  16. Appendix B, Section 2.02 has the correction for partial year.
  17. You can't integrate SH.
  18. What is a "DC Non=Represented plan"?
  19. I don't think 1099 income can be used for retirement plan purposes.
  20. What about a 411(g) amendment. Aren't those usually arbitrary and against normal plan allocations?
  21. Yes. If the participant (account from whom the QDRO came) is counted, too. If the participant is considered a former employee, then no.
  22. You got it, Lou.
  23. Remember, the SH isn't a "just in case" provision. It was an amendment to the plan to provide it. Failure to do so results in an operational failure. If you want somewhat of a just in case provision, you could go with a wait and see (some times called contingent or SH with follow-up) non-elective. This way, you could do mid-year testing, and if you are passing handily, you could just send out the "we're not gonna do SH this year" notice.
  24. I'd just self-correct and move on. (I would, however, adjust that $109 with earnings from when the original refund was done).
