  1. In my humble opinion, If you are not performing services for the SEP, you should recommend that the SEP administrator and/or service provider address any issues in which the SEP is involved.

    If the Employer in question has already adopted the MEP then it would not be a successor plan (it is already in place) so the 1 year exclusion does not matter.
  8. Don't forget that the potion to deduct from earned income as 1/2 of the self employment tax will need to be adjusted for the portion of Social Security tax paid (the 6.2% portion) while an employee.

  22. What happens per the plan document if an ongoing participant maxes out? Say if John Doe reached his 401(k) max in October, would he get match in November and December? I would think it would be the same for a newly eligible.
  23. Medical insurance inside a 401(k) Plan? Or do you mean the Sponsor of the 401(k) Plan is considering to allow employees to sell part of their accrued vacation time?
  24. A lot of questions come to mind..... 1. What do you mean by related companies? Affiliated Service Group? Controlled Group? 2. How does the plan define compensation? Might it be only from one of the two "related employers"? 3. What types of business entities are the "related employers"? So many issues and so little time.....
