Union ee's disaggregated so you do not have to give sh match to them. non union ee's get the sh match. safe harbor plan with 3% non-elective contribution would go to all the union and non-union staff. right? Tom Poje Posted September 25, 2002 Posted September 25, 2002 without looking it up, my initial guess would be no, union ees would/could be excluded. a safe harbor 401(k) plan must either give a shnec or a shmac to pass the ADP test. I don't see why there would be a difference if the method chosen is nonelective or match. you are still disaggregating (union/nonunion peple) the ADP test in either case.
Guest pclark Posted September 25, 2002 Posted September 25, 2002 The Prototype document we use states that all employees entitled to make elective deferrals are eligible for the safe harbor contribution. An employer using our P/T would have to give the S-H to the union employees.
