Guest Jack19 Posted July 11, 2008 Posted July 11, 2008 Does anyone know the bear minimum that 401(k) sponsors have to disclose to participants under ERISA in regards to investment and expense information when the participant requests it? Is there anything beyond the annual report summary required by section 103?
Guest Sieve Posted July 11, 2008 Posted July 11, 2008 Not absolutely sure what you're asking, but participants are entitled to the Annual Report itself (Form 5500) upon request. You may or may not know, but annual returns are available to the public, and are posted on freeerisa.com.
rcline46 Posted July 11, 2008 Posted July 11, 2008 If this is a self directed plan, then use the ERISA 404© disclosures EVEN IF the plan doc does not say they are complying with 404©. I would not want a client who is trying to do only the minimun in today's environment.

There are plenty of pooled separate accounts and other investment vehicles that do not have publicly available returns. And I thought freeerisa just had past filings and some company info. QKA, QPA, CPC, ERPATwo wrongs don't make a right, but three rights make a left.

JanetM Posted July 15, 2008 Posted July 15, 2008 Participants should receive prospectus (or summary) for funds, if they can pick stocks they should request annual report and reserch interim SEC filings. Participants also have a right to see the form 5500 and all attachments except the SSA form. What kind of questions are you trying to answer - at individual investment level or at aggregate plan level? JanetM CPA, MBA
