BG5150 Posted March 17, 2011 Posted March 17, 2011 I have a deceased participant whose beneficiary is not a US citizen, nor does she (the beneficiary) have a US taxpayer id. How do I go about paying her out? Do we have her fill out a W-8BEN along with the regular plan paperwork and that's it? Do I have to do some research on the tax treaty between US & Poland? QKA, QPA, CPC, ERPATwo wrongs don't make a right, but three rights make a left.

According to IRS Pub 901 P 11 there is no exemption from income tax for US pension benefits paid to a Polish citizen. Benefits will be subject to 30% withholding rate. Bene needs to get a tax id no. from the IRS in order to make payment. mjb
