Stash026 Posted April 25, 2019 Posted April 25, 2019 Just looking for an opinion on this. The Plan states that an "actively employed" participant is eligible for an in-service definition once every 12 calendar months. If the employee is currently out on disability, would he/she still be classified as actively employed (assuming they are expecting to return to work)? Thanks in advance!
CuseFan Posted April 25, 2019 Posted April 25, 2019 Probably - I think someone is either (actively) employed or terminated. If terminated, then obviously there is no need for in-service distribution. If not terminated - so no distributable event - then I think you're considered employed and eligible for in-service distribution assuming all other requirements for such are satisfied. hr for me 1 Kenneth M. Luke Bailey Posted April 26, 2019 Posted April 26, 2019 You mean out on a short-term disability, right, Stash026. If so, I would tend to agree with CuseFan. Luke Bailey Senior Counsel Clark Hill PLC 214-651-4572 (O) | LBailey@clarkhill.com 2600 Dallas Parkway Suite 600 Frisco, TX 75034
