metsfan026 Posted June 11, 2024 Posted June 11, 2024 I know based on Secure an employer needs to allow long-term part-time employees to contribute into the 401(k) portion of the Plan. I also know they can keep them out of the discretionary employer contributions. The question that came up is if these participants are required to get the Safe Harbor Match? I believe the answer is yes, but I'm second guessing myself now.
C. B. Zeller Posted June 11, 2024 Posted June 11, 2024 No, LTPTEs do not need to get SH match. However the plan document needs to say that they won't get it. (proposed) 1.401(k)-5(e)(2)(i) Quote Safe harbor contributions. A plan that is intended to satisfy the ADP safe harbor provisions of section 401(k)(12) or (13) will not fail to satisfy those provisions merely because the employer does not make a nonelective or matching contribution on behalf of an eligible NHCE who is a long-term, part-time employee (or makes a nonelective or matching contribution that does not satisfy the safe harbor contribution requirements of § 1.401(k)-3 on behalf of the eligible NHCE), provided that long-term, part-time employees are excluded for purposes of determining whether the plan satisfies the ADP safe harbor provisions of section 401(k)(12) or (13) pursuant to the election under paragraph (f)(1) of this section. Similarly, a plan that is intended to satisfy the ACP safe harbor provisions of section 401(m)(11) or (12) will not fail to satisfy those provisions merely because the employer does not make a nonelective or matching contribution on behalf of an eligible NHCE who is a long-term, part-time employee (or makes a nonelective or matching contribution that does not satisfy the safe harbor contribution requirements of § 1.401(m)-3 on behalf of the eligible NHCE), provided that long-term, part-time employees are excluded for purposes of determining whether the plan satisfies the ACP safe harbor provisions of section 401(m)(11) or (12) pursuant to the election under paragraph (f)(1) of this section. The plan also does not lose its deemed top heavy exemption merely because it excludes LTPTEs from the safe harbor contribution. 416(g)(4)(H) Quote Such term ["top heavy plan"] shall not include a plan solely because such plan does not provide nonelective or matching contributions to employees described in section 401(k)(15)(B)(i).
