justanotheradmin Posted October 28, 2024 Posted October 28, 2024 Hi Everyone, Self referrals are welcome - a small ESOP company is looking for an attorney who can advise the plan/company about a real estate transaction they are considering in the very near future. For privacy purposes I won't post the details here, but if anyone could suggest an attorney they could contact, it would be welcome. If you send me your contact information - I'm happy to give more details privately to see if the scenario is something you are interested in working on - before I pass along your contact information to the ESOP. Thank you all. I'm a stranger on the internet. Nothing I write is tax or legal advice. I'd like a witty saying here, but I don't have any. When in doubt, what does the plan document say?
Peter Gulia Posted October 28, 2024 Posted October 28, 2024 While recognizing your aim of not putting too much information on a public website, it might help if you can, without risking privacy, mention: Is the retirement plan buying? Is the retirement plan selling? Is the company buying? Is the company selling? Is the buyer not a party-in-interest regarding the retirement plan? Is the seller not a party-in-interest regarding the retirement plan? Is the real property employer real property? Is the search for a lawyer to advise the buyer? Or a lawyer to advise the seller? Or a lawyer to advise the plan’s fiduciary, even if the plan is neither the buyer nor the seller? Which expertise does the advisee seek? Planning for ERISA-prudent decision-making? Or experience in real-property transactions? Or a firm with lawyers in both practices? justanotheradmin 1 Peter Gulia PC Fiduciary Guidance Counsel Philadelphia, Pennsylvania 215-732-1552 Peter@FiduciaryGuidanceCounsel.com
justanotheradmin Posted October 29, 2024 Author Posted October 29, 2024 All valid questions - its a very unique situation, so I don't know how comfortable I am putting the answers on a public forum. If I get permission from them to post more details I will. I'm a stranger on the internet. Nothing I write is tax or legal advice. I'd like a witty saying here, but I don't have any. When in doubt, what does the plan document say?
