HIPAA may be long in the tooth, but it still packs a powerful bite. To date, the Office for Civil Rights (OCR) has settled or imposed a civil monetary penalty in 95 cases totaling over $135 million. Recent settlements involve business associate agreements and release and delayed access to patient records, much due to a lack of basic controls. Recent appellate court activity may indicate a need for future regulatory reform or increased push back from organizations for a more common sense approach.
