Excerpt: [B]ecause the Commission's proposed solution discriminates against retirement plan participants, it will fail to restore investor confidence in the equity and soundness of mutual funds.... The proposed amendments discriminate against participants in § 401(k) and other retirement plans and are likely to reduce retirement savings by discouraging employees from participating in retirement plans.
