Excerpt: [T]he United States Supreme Court has agreed to hear the Sereboff case to determine the appropriate scope of equitable relief available under Section 502(a)(3) of ERISA. At stake is a plan fiduciary's ability to seek reimbursement for medical expenses paid by a plan to a plan participant who has also recovered damages from a third-party tortfeasor.
