[Guidance Overview]
Ninth Circuit Clarifies Scope and Application of 'Surcharge' and 'Reformation' Remedies under ERISA
"[The Skinner case] is a welcome decision for plan fiduciaries. It is, however, only the first appellate opinion on the subject post- Amara.... [E]mployer/plan administrators should continue to subject their plan documents and benefits communications to a careful review to ensure their accuracy and clarity." (Littler)

Washington State GOP Lawmakers Won't Budge on Pension-Overhaul Plan
"Senate Republicans want to skip a $133 mil.lion payment toward funding older, closed pension plans for teachers and state workers as a way to help balance the state budget.... But the GOP tied that move to provisions ending early-retirement options for new employees[.]" (The Seattle Times)

Should You Contribute to Your 401(k) If Your Employer Doesn't Match Contributions?
"In essence, [the question is], 'What should I do with my investment money?'" (Business Insider)

401(k) Fee Disclosure Rules 'Good for Participants,' DOL Official Says
"Rule 404(a)(5) provides plan participants an apples-to-apples comparison across product types.... In the past, different products have been regulated by different entities." (AdvisorOne)

For 401(k) Advisers, Time to Shelve Old Benchmarks
"For financial advisers who specialize in 401(k) plans, a successful participant outcome is the end goal. Defining exactly what 'success' is needs some rethinking, however." (Investment News)

Washington State Latest Jurisdiction to License Same-Gender Marriages
"Washington joins seven other U.S. jurisdictions that currently license same-gender marriages. However, because under the federal Defense of Marriage Act (DOMA) federal tax benefits for spouses are limited to spouses of the opposite se.x, legal recognition of same-gender marriage by the states can raise complicated issues for both defined benefit (DB) and defined contribution (DC) plans that are controlled primarily by federal law." (Segal)

Kansas House OKs Cash Balance Plan for State Workers
"The Kansas House passed a bill Tuesday that would close the $13 bil.lion Kansas Public Employees Retirement System to new state employees.... Under the bill, employees hired on or after Jan. 1, 2014, would receive a one-time choice of being enrolled in a new cash balance plan or a new defined contribution plan." (Pensions & Investments)

Senate Highway Bill Includes Provisions to Stabilize Pension Funding
"The [bill] includes provisions that would stabilize the interest rates for determining the funding obligation for single-employer pension plans. The bill is now headed to the House where, despite its bi-partisan support in the Senate, passage is uncertain." (Deloitte)

[Opinion]
What Might Replace the 401(k)?
Just 15 years ago 401(k) plans were widely embraced. Workers enjoyed managing their own money, believing that 10% annual returns for life would be a layup. Employers were happy to match contributions, giving them cover to shift away from costly traditional pension plans. Policymakers thought they had found an answer to the fraying social safety net. Today it all looks like a big mistake. (TIME)

[Opinion]
ASPPA's Comments at Hearing on Massachusetts' New 'Universal Voluntary Retirement Accounts'
"The reason given for the proposal (as stated in the first sentence of Section 1 of H.1194) is that 'The legislature finds that small and medium sized businesses find it difficult to offer retirement plans because of the complexity and costs.' This assertion simply is not true, and the proposed 'solution' of Commonwealth-run employer-based retirement savings arrangements would not only fail to address a real problem, but would do so at a substantial cost and potential liability to the Commonwealth." (American Society of Pension Professionals & Actuaries)

[Opinion]
ASPPA's Statement at Hearing on 'Opportunities for Savings: Removing Obstacles for Small Business'
"There are two myths about small business and retirement savings plans that [ASPPA addresses] up front: Myth #1: Service providers are not interested in helping small business set up or operate a retirement plan.... Myth #2: It is cost prohibitive for a small business to sponsor a retirement plan." (American Society of Pension Professionals & Actuaries)

[Guidance Overview]
Upcoming IRS Guidance Regarding the Nonqualified Deferred Compensation Plans of Tax-Exempt Organizations (PDF)
"Apart from one brief regulation issued several years ago, the [IRS] has never issued comprehensive guidance for 457(f) plan sponsors. Comprehensive guidance has been discussed and was expected to be issued in 2011, but did not occur.... However, new guidance is anticipated within the next few months in the form of proposed regulations." (Drinker Biddle)

Title VII Protection of Severance Benefits Extends to Former Employees
"Former and current employees can seek redress under Title VII of the Civil Rights Act of 1964, says [the U.S. Court of Appeals for the Fourth Circuit] in a case involving a severance package." (Business Insurance; free registration required)
