  1. Mr. Wallach has posted and reposted this same article scores of times on nearly every forum of BenefitsLink to the aggravation, irritation, annoyance and consternation of many forum members and in violation of forum rules and administrator requests. I'm surprised you missed it, Rene.
  2. Here are the possibilities as first came to mind. (certainly not to preclude other possibilities) 1) Rene is covertly associated with Lance Wallach and intentionally put forth this story to allow for the opportunity to post Lance's materials. 2) An astounding coincidence has ocurred. 3) Rene has a very subtle sense of humor.
  3. myatt: Do you know the best way to reach my ergomaniacal brother WTYD? It's been years since we've seen him at any of our family gatherings. His wife tells us he's at the office, but I only get voicemail.
  4. ...until IRS deposit records don't match up with the 945 filings.
  5. I think I have the same carrier. 1) Lose a lot of sleep. 2) Consult an attorney. 3) Lose some more sleep. 4) Consult an authority hire than an attorney. 5) Approach the client and hope for the best. (Not necessarily in that order.)

    Form 5500-EZ

    The latter.
  7. The fact that an approach was previously taken should not be sufficient justification, in and of itself, to continue that practice. You should follow the terms of the plan document and explore the options under the various correction programs if these terms were violated.
  8. It may be both interesting and amusing to review this thread, even though it is several years old. http://benefitslink.com/boards/index.php?showtopic=16760

    Timing of 5500 filing

So if you don't complete the return until you have verified the contribution, you don't run into the scenario from the original post anyway. We try to follow this approach. I agree that this isn't a big deal either way and one should do what is within one's comfort zone.

    Timing of 5500 filing

You can file, but what is the downside of waiting?

    Timing of 5500 filing

Save yourself the subsequent headaches and file the return after the contribution has been verified.

    Timing of 5500 filing

Save yourself the subsequent headaches and file for an extension.
  13. I definitely think that a formal complaint should be made through appropriate channels. (After the audit has been closed, of course.)
  14. Not even close.
  15. Who is your document provider? (If you don't mind sharing.)
  16. Isn't the annual funding notice only required for plans covered by the PBGC?
  17. Yes, but remember that the filing deadline corresponds with the final distribution date (probably resulting in a short plan year), not the normal plan year.
  18. The $50,000 of loans is a plan asset and should be included in the plan's assets as reported on Schedule I. (Lines 1a and 1b) The interest portion of the loan payments will show as income on the Schedule I as well. (Line 2c) Line 3e will show the total ending value of the participant loans.
  19. Certainly ample time as the Form 5500 is not due until 7 months after the final distribution.
  20. When the information on the SAR would change?
  21. Perhaps Publication 560 would be of assistance. Look at page 5. http://www.irs.gov/pub/irs-pdf/p560.pdf

    Missing 5500

    1) Make sure the delivery address was correct. 2) Keep the delivery verification in a safe place. 3) Wait and see.
  23. In my experience, this approach is very uncommon.
