  1. I did find a post here... in it the plan was a DB plan and the answer was NO, it would have been a PT. The plan I am concerned with is a MP... I have been trying to amend it for years to a PS... he is simply non responsive to the idea. He is a very smart guy.... I am sure if he could liquidate he would... maybe there are fees involved or some other reasons. To sum it all up... A 401 or a straight PS plan and it can be done? Want to know for future questions. Thanks!
  2. A client wants to pay his contribution in "Kind"... wants to transfer stock to the plan to cover his 2004 employer contribution receivable. Is this fine? If so, what documentation needs to be in place to a future audit? Thanks!
  3. What is the benefit of more than 2 rate groups.. nothing? 2 Doc's in group 1... $200K+ each 1 younger Doc in group 2... $200K+ all the rest NHCEs in group 3

  5. So it is simply a design issue... has the plan included in-service and hardship distributions in the document. And only PS plans. Thanks
  6. Client has a New Comp plan... has an EE who wants a hardship dist. Are hardship distributions only allowed from K plans?
  7. I was contacted by a co-trustee who can not find the document of her husband's plan. American funds will not allow her to gain access to the funds because they do not have her listed as a trustee. They want to see the doc. She is not a client (not yet)... What are her options? Plan was established in 1998 and he was the only participant.... FYI
  8. Dsyrett... there is a place online called "instant replay" or something like that. It allows season ticket holders to sell their tickets if they are not going to be around for the game. I think you need to register through the Red Sox site and is done through the Red Sox organization ( I think)... did you try that? What is sad is that a family that is not raking in the cabbage cant afford to take their children to a baseball game. Grand Stand tickets... $75 each? Outrageous! I remember going to the game and buying grand stand tix for $6 .... and arriving the day of the game to buy them. I understand that it is a business. I guess I long for the good ol'days. What a game last night! I watched it to the end... walk off home run by the error stricken Kevin Millar. What a finish! Oh, and I do have to give credit to Byrnes for catching Nixon's slicer in left field... fabulous catch! That will make the the weeks highlites on all the sports channels. ok.. back to work.
  9. I came to your same conclusion.. but was told that he is a great SS. Theo the wonder boy has done good so far. Lets see how he turns out as the season progresses.... (I liked Cabrera !) do I see another rivalry? Tampa Bay? Bench emptying innings and pitches thrown at peoples heads? who said baseball is boring!

  11. New client with 2 partners.... each partner filed for the SS4 for the new plan. Anyone dealt with this situation? Do you simply not use the extra SS4 ? do you notify Uncle Sam?
  12. How long does an IRA have to be in effect? Here is why I ask.... - Cleint sponsors a 401(K) plan and maxes out - Client makes an IRA contribution - Client now wants to roll the IRA into the K plan What is to prevent the client from doing this every year ... is there a rule that does just that?
  13. Blinkey... that was my first thought... someone who has been administering X-tested plans and doesnt know what an EBAR is? I guess my wit is not as quick as yours... or maybe you have 3 b*lls in addition to 3 eyes when it comes to posting (Example REF: your post about the generous plan sponsor and the monument erected in his behalf). Maybe when I get to 2300 posts I will be as bold as you. I will admit... I enjoy your posts and found myself giggling when I read many of them.   15. Tom.. using your example, if it was not a match but rather a SH 3% NEC, can the 3% be part of the gateway? and will it (the 4.44% gateway) also cover TH in essence killing 3 birds with one stone (gateway, SH, and TH)
  16. Cabrera did work well late last year... some clutch hitting in the playoffs and excellent fielding. I never understood that... letting him go. Was it a $$ thing also? The new SS looks a little rusty. Cant let the Yanks intimidate us... I wonder what is going on with the game today?

  19. Correct... my understanding is that if the refinancing was to replace the actual initial principal residence loan it would have been ok... but a simple 2nd mortgage loan can not be issued by a plan and have a term of 15 years.... as per the example.

  21. Newly disabled client establishing a plan... wants to borrow to renovate his principal residence or eliminate 2nd mort. Can term be longer than 5 years? Not a purchase.

  25. What happens when a participant dies and there is an outstanding loan that the surviving spouse knew nothing about? No spousal signature on the loan doc. Is she liable for the loan? any recourse?
