  10. Just to be a stickler... a Domestic Relations Order (DRO) doesn't become a QDRO (Qualified Domestic Relations Order) until the Plan Administrator so rules. Or am I missing something?
  11. Pay minus SS and MC is all that's left. If 100% of that (roughly 92% net) is deferred, no Fed taxes. Some states may not follow along. I don't know of any that don't. Send 401k money ASAP.
  12. Only deferrals in excess of 402g are catch-ups, in my understanding. So deferrals over $14,000 in 2005 could possibly be catch-ups. Yes, 415 would disregard up to $4,000 (2005) of deferrals in excess of $14,000.

  14. Have a 50+ (9/30/05 fiscal) client that wants to max the PS contribution. Deferred $17,950. Can I calc the contrib so that he gets $45,000, or would only #3,950 be considered a catch up?
  15. Depends on whether there is a plan-imposed election period. I've not used election periods, but some might. Especially large plans.

  17. My 2 cents. Had a plan with Real Estate just last year. Got an appraisal with a RANGE of 675-725k. Long time participant was due a payout, and trustee said use the high estimate. Paid out at 725. Property sold 6 months later at $935k. Yeah, I sleep as well as everyone else... not.
  18. Thanks for the props, monkey-face. As far as service, ftwilliam has been very forthcoming with support. Example: Their 5500 software was (don't ask me how) making up zip codes. I emailed them and it was fixed in about 1 day. Question: I haven't heard any furour yet, but Datair insists that the 5500s can't be sent as PDFs to clients. ftwilliam generates their 5500s as PDF files, with the caveat that you turn off any "Fit to page", "Shrink to Fit", etc. options. I print paper copies to be sent to clients, but the 15th is coming. Any experiences?
  19. Sounds like reliance on "Otherwise excludible". Would like to see how the plan's language includes them. Perhaps they're not otherwise excludible, for example based on an elapsed-time eligibility provision.
  20. Barry, With all due deferance. Due to a DRO, I'm asked to split my IRA 50-50. Spouse asks for attorney fees. Couldn't we agree on 40-60 with the understanding that the attorney gets paid from the difference? No reference materials here, but money is fungible...

  22. I'll have to assume husband is over the comp limit for plan purposes. Otherwise, why pay the FICA on a second income? Also assume that the contribution is large enough to justify the FICA expense.

  25. Try www.apboard.com. I'm of the opinion that what a third-party would pay is fair market value. Lots of room for debate, but its something you can print for the file.
