  5. We are looking at our hardship withdrawal form and want to had a paragraph. We have the paragraph about stopping deferrals for 6 months. We want to had a paragraph to put responsibility to restart on the participant. We are discussing how to word this for plans with and without automatic enrollment and with and without automatic escalation. Does any one have any suggestions? What other problems have been caused by this situation or solutions you have tried?

  7. Let's say a plan has autoenrollment, and someone decides to opt out after $20 is taken from one paycheck. What are the mechanics of his refund, is it a normal distribution or is payroll reversed?
  8. I have never seen this before. I have seen comp before Participation being excluded. If the plan has a 1,000 hour requirement for discretionary non-elective, is it legal to exclude hours before Plan Entry?

  10. The QDRO says nothing about our distribution fee. It says to give the alternate Payee $5,000 +G/L form August 12, 2016. Do you think we can take half of our distribution fee out of her $5,000?

  15. I agree with Tom. I have seen it show up as a contribution. But on an audit, I would have no problem explaining why I did not count earnings in the 415 limit.

  17. If no employees other than owners, met eligibility, you have an owner only plan. With assets less than $250,000, no 5500 is required.
  18. My understanding is that there is a choice between filing an SF electronically with the EFAST on a public wesite or an EZ on paper. We are a CPA firm. So, we file more than 250 forms per year. But I don't like the idea of filing the form on a public website. Can I prepare the form 5500EZ and have the client mail the paper form to the IRS?
  19. You are covered, but that is not the way I would say it. If deferrals and Safe Harbor contributions are the only allocation anyone received, the Plan is deemed to be "not top heavy".

  21. You are correct. You do not want to do a rollover. You want to do a trustee to trustee transfer. If i were you, I would go somewhere to open the new SIMPLE and tell them I want to open an account and transfer money into it.
  22. SEP puts in 8% of comp and has eligibility of "having worked for employer one of the immediately preceding 5 years. Employee starts 11-5-16 Should he receive a contribution for 2017? how about 2016? Or does he have to work 12 months?

  24. Foundation has a 403(b) for deferrals so they have no ADP test. They put 5% into everyone's SEP-IRA. Can anyone tell me the advantages to put the discretionary non-elective into the SEP instead of into the 403(b)?
