Non QJSA 401(k) spousal waiver for beneficiary - Participant found on line where she does not need spousal waiver if Husband is 50% beneficiary. Is this correct? If this is not right, where can I find in writing the rest of the story?

FWIW I think it is legal to make this change now.

repay an old defaulted loan?
Jim Chad replied to AlbanyConsultant's topic in Distributions and Loans, Other than QDROs
If a plan allows 2 loans, can someone with one defaulted (deemed in 2011) loan, take out a second loan? -
We are looking at our hardship withdrawal form and want to had a paragraph. We have the paragraph about stopping deferrals for 6 months. We want to had a paragraph to put responsibility to restart on the participant. We are discussing how to word this for plans with and without automatic enrollment and with and without automatic escalation. Does any one have any suggestions? What other problems have been caused by this situation or solutions you have tried?

Let's say a plan has autoenrollment, and someone decides to opt out after $20 is taken from one paycheck. What are the mechanics of his refund, is it a normal distribution or is payroll reversed?

TPA distribution Fee
Jim Chad replied to Jim Chad's topic in Distributions and Loans, Other than QDROs
Corbel Vol Submitter SPD Says that it may be charged to Participant's account and so does our service agreement. -
The QDRO says nothing about our distribution fee. It says to give the alternate Payee $5,000 +G/L form August 12, 2016. Do you think we can take half of our distribution fee out of her $5,000?

Change of 401k providers, changed repayment (principal reduction) rule?
Jim Chad replied to enzamatic's topic in 401(k) Plans
Also, you could increase your loan payment amount to equal your net pay check and use the $40,000 in saving to live on. -
Top Paid group only takes people out of the HCE group for testing. It never puts anyone in.......I think.

FWIW I would think that would be no problem.

Lost Earnings on Late Deposits
Jim Chad replied to DocumentDiva's topic in Correction of Plan Defects
I agree with Tom. I have seen it show up as a contribution. But on an audit, I would have no problem explaining why I did not count earnings in the 415 limit. -

Agreed. Earning are earnings. -
If no employees other than owners, met eligibility, you have an owner only plan. With assets less than $250,000, no 5500 is required.

My understanding is that there is a choice between filing an SF electronically with the EFAST on a public wesite or an EZ on paper. We are a CPA firm. So, we file more than 250 forms per year. But I don't like the idea of filing the form on a public website. Can I prepare the form 5500EZ and have the client mail the paper form to the IRS?
-
You are covered, but that is not the way I would say it. If deferrals and Safe Harbor contributions are the only allocation anyone received, the Plan is deemed to be "not top heavy".

On my first attempt to e-file and 8955-SSA, I received an email saying the filing was bad. I use Relius Government forms. Does anyone have any suggestions on where I should look for problems?

SEP puts in 8% of comp and has eligibility of "having worked for employer one of the immediately preceding 5 years. Employee starts 11-5-16 Should he receive a contribution for 2017? how about 2016? Or does he have to work 12 months?

If yes, why? If no, why not?

Foundation has a 403(b) for deferrals so they have no ADP test. They put 5% into everyone's SEP-IRA. Can anyone tell me the advantages to put the discretionary non-elective into the SEP instead of into the 403(b)?
