thepensionmaven Posted November 7, 2018 Posted November 7, 2018 Client currently has 401(k) with 3% SHNE. No ER profit sharing. they want to add a provision for voluntary contributions. this this allowed and would any testing be involved, and what type?
david rigby Posted November 7, 2018 Posted November 7, 2018 Does "voluntary contributions" mean "after-tax contributions"? I'm a retirement actuary. Nothing about my comments is intended or should be construed as investment, tax, legal or accounting advice. Occasionally, but not all the time, it might be reasonable to interpret my comments as actuarial or consulting advice.
Lou S. Posted November 7, 2018 Posted November 7, 2018 Allowed ACP testing on the after tax voluntary. also subject to 415 limits

thepensionmaven Posted November 8, 2018 Author Posted November 8, 2018 Yeah, voluntary after tax, so we must do the ACP testing. Good thing a few of the HCEs will not be contributing! Just the owners. I do realize 415. Thank you.

BG5150 Posted November 8, 2018 Posted November 8, 2018 Hopefully, it's the owners AND some NHCE's who will make after-tax contributions... QKA, QPA, CPC, ERPATwo wrongs don't make a right, but three rights make a left.
chc93 Posted November 8, 2018 Posted November 8, 2018 I think I misread the post... doesn't say that the owners are not HCE's, which was my first impression. But yes, without sufficient NHCE's contributing, no pass.
