Philip Posted August 4, 2020 Posted August 4, 2020 I just realized that my previous employer didn't pay most of my payroll deductions or the company match for 9 years into my account. I don't even know where to begin getting my money back. Can someone help?
C. B. Zeller Posted August 4, 2020 Posted August 4, 2020 Have you asked your employer about it? If they realize they made a mistake they should be willing to correct it. Free advice is worth what you paid for it. Do not rely on the information provided in this post for any purpose, including (but not limited to): tax planning, compliance with ERISA or the IRC, investing or other forms of fortune-telling, bird identification, relationship advice, or spiritual guidance. QDROphile Posted August 4, 2020 Posted August 4, 2020 All ERISA plans have written procedures for filing a claim for benefits. That is the formal mechanism for determining and receiving your benefits. A copy of the claims procedures are available to you without charge. However, I agree with C.B. Zeller that your first stop is an informal inquiry to the person at the employer who is responsible for plan matters.
Bill Presson Posted August 4, 2020 Posted August 4, 2020 In addition to the above, you should also make sure you have access to all the w-2 forms for the years in question. And find any statement if any money ever went in. Is it possible that you THOUGHT you elected to make a contribution but never actually did? If there are no deferrals showing on the w-2 forms, the employer didn't fail to deposit anything. William C. Presson, ERPA, QPA, QKA bill.presson@gmail.com C 205.994.4070
