Don't know whether this changes the analysis or not, but I think the OP meant to say "not TopHeavy". -

Mandatory 100% QJSA
Mike Preston replied to Ananda's topic in Distributions and Loans, Other than QDROs
David, please stick to lawyering. Your example would be actuarial malpractice if submitted by an actuary to a court. I don't have time to lay it all out for you but basically you are comparing apples to oranges and assuming they are the same thing. Your $1,667 is payable to the alternate payee for as long as the participant is alive. While your $1,500 is payable for a potentially much longer period of time. To merely subtract one from the other without making an actuarial adjustment is not the way it should be done. -

Dental practice with 3 plans

Why do you think it unlikely? They are set up as Trustee of the specific plan they participate in. I know firms that have dozens of these. They trace back to when 401(a)(26) was amended so as not to apply to DC plans. -

They want separate plans because they need separate plans. Each plan is trustee directed. No discrimination. IRS has blessed this arrangement for years. Holland and wickersham yes wickersham are on tape specifically stating that this design works and is not discriminatory. -
You are correct. Blame it on jet lag.

This is amazingly confused. Why are you listing catch-ups of any kind for somebody age 55?
